Do I need a real estate attorney when buying a home?
In some states, it is necessary or customary to hire an attorney when buying a home; in other states it is not. If the buyer is represented by a real estate agent, that agent, along with an escrow officer, can handle the necessary legal details in some states.
If the agent is also representing the seller in a "dual agency" situation, the buyer should consider hiring a lawyer.
If the buyer is not sure about his rights and responsibilities or if the transaction is complicated, the buyer should hire an attorney.
